Freedom of Information
Introduction

The Freedom of Information Act 2000 places duties on all public authorities, including police authorities and police forces. The Act is part of a wider initiative to make government and its decision-making processes more open and accountable and provide authorities with an opportunity to review their openness and accessibility.
The Information Commissioner is responsible for promoting the Act, advising on good practice and may overrule an authority's decision not to disclose information.
Summary of the Act
The Freedom of Information Act 2000 was fully implemented in January 2005 and allows any individual or body to have the right of access to information held by the authority. This right of access includes both a right to be told whether the information exists, as well as the right to receive it. From June 2003, both police authorities and police forces were required to adopt and maintain a 'publication scheme' and to publish information in accordance with the scheme.
Publication Schemes
Under the Act, police authorities and police forces are required to adopt and maintain a publication scheme which sets out:
the classes of information it publishes or intends to publish
the manner in which it intends to publish the information
whether a charge will be made for the information.
The purpose of the publication scheme is to ensure that a significant amount of information is made available to the public, without the need for a specific request, and to encourage pro-active publishing of information. In addition, it will help to promote greater openness and transparency in public authorities.
Model Publication Scheme
From January 2009, a new model publication scheme was introduced by the Information Commissioner, which standardises the way public authorities explains what information it proactively publishes.

1. This information is published within our Statement of Accounts. I refer you to our website where information on the Police Pension Fund is detailes on page 34 of the Statement of Accounts for 2009/10 with comparator information for 2008/09. The Statement of Accounts for 2010/11 will be published on our website in September 2011. I can advise that the amount budgeted for employer's pension contribution for 2011/12 is £42.403 million. 2. Hampshire Police Authority has not published information about the amount of gross budget spent on pensions in its council tax leaflet since 2005/06. Up to and including this year, the Authority had to pay for police officer pensions on a revenue basis, that is it had to make up the difference between the value of pension paid out each year for retired police officers and the value of contributions made by serving officers. This was an unfunded scheme and there used to be a line in the Police Authority's budget for police pensions which might be what you are referring to. In 2006/07 the Government changed the scheme to a funded scheme which operates differently. The Authority deducts the employee contributions from serving officers and pays over these with the employer's contribution to the pension fund managed by the Home Office. The Home Office then pays for all pension outgoings to retired pensioner officers. |

Hampshire Police Authority (HPA) does not hold this information in a retrievable format. The cost of determining if the information is held, locating and retrieving the information exceeds the ‘appropriate level’ as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. It is estimated that it would cost more than £450 to comply with your request. HPA first received a paper which referred to Alpha Park at its meeting on 10 June 2008, the site having previously been identified by Hampshire Constabulary earlier in 2008. As the site is still owned by the Authority, the timeframe for consideration is therefore at least 3 years 3 months, possibly longer. To ensure that all information is identified and reviewed, each Member of the Authority and member of staff who has been in post between May 2008 and July 2011 would need to be contacted and asked to look through their correspondence and emails. This is potentially a huge task. Since 2008 there have been 25 Members of the Authority and 22 members of HPA staff. It would include papers held by the Chief Executive, Treasurer and Deputy Treasurer and Legal Advisor to the Authority for the relevant time period, three of these officers have now retired. In addition, one Acting Chief Executive in post for a six month period was seconded from another public authority. Assuming that each recipient would be required to spend between 1 – 2 hours determining if information is held, locating and retrieving it, this would exceed the statutory cost limit for a single FOI request. Please also note that Freedom of Information covers only information held in a recorded format and as such, the element of your original request to HCC relating to a ‘summary of verbal advice’ falls outside of the scope of the Act. However we do hold information that states that Members did 'unanimously' agree to the recommendation 'That the Authority approves that no police station will be decommissioned until such time as the Safer Neighbourhood Team in that building is provided with suitable local premises. Any proposal to close a police station should also be cognisant of the decisions taken following the Front Office Review.' 1. The Constabulary complies with the relevant taxation laws and regulations, including VAT. VAT is only reclaimed where allowable but the Constabulary does seek to maximize the amount of VAT it is permitted to reclaim from Her Majesty's Revenue & Customs. VAT was reclaimed on the site acquisition cost. 2.No consulting engineer or estate agent was instructed in the search for these premises. The search was carried out by staff from Hampshire Constabulary Estate department with some help from Hampshire County Council Estates. 3. Hampshire County Council and MACE were instructed to carry out a feasibility study with various alternative layouts and internal planning after the property had been purchased. None of these proposals were implemented because of changes in the financial climate leading to the comprehensive review of the whole Police estate carried out in 2010. Fees and expenses incurred in respect of feasibility studies, scoping works and planning issues prior to comprehensive review of police estate: MACE £131,210 Hampshire County Council £76,943 4. The legal work associated with the aspects of site acquisition were incurred internally by the Constabulary Solicitor's Department. 5. The annual running cost of the premises are given within this table. 6. The premises have not been sublet although negotiations were carried out at various times for possible sub lettings. For about 2 years after purchase a local commercial agent was instructed to try and find suitable temporary occupants for all or part of the accommodation but without success. The cost of owning, maintaining and keeping the premises secure has been mitigated as much as possible during the period of ownership. The current proposals, which are part of the comprehensive estate development plan, are to retain and develop the rear part of the site. The front part is intended to be sold to help pay for the development of the remainder of the police estate. The price will be fixed at the time that the property is placed on the open market based on advice from the marketing agents and the estate consultants working for the estate development programme. It will represent the best open market value for the property at that time. The cost of agents fees and legal costs will be subject to negotiation at the time of marketing and will represent the best value for money for the services required in accordance with our normal procurement rules. |

1. Yes, a panel was convened on one occasion in the three year period. 2. This information has been exempted by virtue of the following exemption: S40 Personal Information S40 (2) (a) applies to third party personal data. This would not be released under the Freedom of Information Act as any release would breach the Data Protection Principles contained within the Data Protection Act (1998). Personal data is defined under the Data Protection Act (1998) as data that is biographical in nature, has the applicant as its focus and/or affects the data subject's privacy in his or her personal, professional or business life. 3. The decision of the Chief Constable was upheld by the panel. The panel gave approval to the Chief Constable to dispense with the officer's services. |

In addition to Hampshire County Council legal department which I am including as external, the Authority occassionally uses law firms who are selected by Hampshire County Council under their tendering process. 3.
